This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and the terms and conditions for access or usage of alphonsomatrimony.com (the "Website").

ACCESSING, BROWSING OR OTHERWISE USING THE WEBSITE INDICATES YOUR AGREEMENT TO ALL THE TERMS AND CONDITIONS herein, SO PLEASE READ THE TERMS AND CONDITIONS CAREFULLY BEFORE PROCEEDING. By impliedly or expressly accepting these Terms and Conditions, You also accept and agree that you have read, understood and are bound by these Terms and conditions. If you do not want to be bound by the Terms and Conditions, you must not use the Website or the AM Services.

In these Terms, references to "You" or "User" or "AM member" shall mean the end user accessing the Website / AM services, its contents or using the AM Services offered.

Scope

Alphonso Matrimony [AM] acts as a platform to enable any user to themselves register on it (by filling the mandatory and optional fields) to voluntarily search for profile(s) from the database of Alphonso Matrimony's already registered users, for seeking prospective lawful matrimonial alliances for themselves. The profiles in the database of AM are classified broadly on the basis of language and region for the ease and convenience of its members. AM Members are provided with free/paid access for searching profiles from the database, as per the partner preference set by you, and you shortlist the prospective alliances yourself. AM does not authenticate any information of any profile and hence you as a user need to verify the credentials and information provided by other users.

1. Eligibility

A) AM Membership and rights of admission is reserved solely for: Indian Nationals & Citizens; Persons of Indian Origin (PIO); Non Resident Indians (NRI); Persons of Indian Descent or Indian Heritage; Persons who intend to marry persons of Indian Origin.

B) Further, in capacity as AM member you confirm that you are: 18 years or above (if you are a woman) or 21 years or above (if you are a man); Legally competent to marry as per the law applicable to you; and Not prohibited or prevented by any applicable law from entering into a valid marriage.

2. Registration

We expect that you would complete the online registration process with fairness and honesty while furnishing your personal information to AM. Efficient and effective match making through our automated system depends upon yourself furnishing true, accurate, current, complete information and photos. You alone shall be responsible for any information provided to AM.

If at any point of time AM comes to know or has reason to believe that any information provided by you for registration (including photos) is found to be untrue, inaccurate, or incomplete, then AM shall have full right to suspend or terminate (without any notice) your AM membership and forfeit any amount paid by you and refuse to provide AM service to you thereafter.

AM Membership is restricted strictly to the registered AM individual member only. Organizations, companies, businesses and/or individuals carrying on similar or competitive business cannot become Members of AM and nor use the AM Service or AM members data for any commercial purpose.

3. Role and Responsibility of AM

AM is an endeavor to help you find your life partner through a process of automated searching, short listing and contacting prospects amongst our registered members. AM reproduces your details once you register on our website on "as is as available" basis. AM's obligation is only to provide an interface to its registered members to search their prospect themselves. AM cannot guarantee or assume responsibility for any specific results from the use of the data available from the AM service.

4. Role and Responsibility of AM Member

Members ensure to keep their username and password safe and confidential. AM Members are requested to exercise due care and caution while short listing the prospect and satisfy themselves before making a choice of their match through adequate efforts, initiatives and due diligence. AM shall not be liable for any shortcoming due to any misrepresentations made by any of its members. AM Members are expected to verify the credentials of the prospect such as family status, marital status, educational qualifications, financial status, occupation, character, health status, etc. AM Members are expected to refrain from entering into any financial transactions with prospects, sharing confidential and personal data such as bank details, entering into a physical relationship before marriage, or violating any law in force.

6. Medium of Communication to AM Members

AM member hereby consents to receiving communication including promotional communications through any medium such as Emails and/or SMS/Calls from AM or their alliance partners. You are entitled to set up your communications frequency from AM. You may also opt for not getting any call from AM by ticking the appropriate box in the Website.

7. Confidentiality

AM has reasonable processes and systems in place to maintain confidentiality of all personal information other than those meant for sharing with the prospect. Any feedback you provide to AM shall be deemed to be non-confidential.

8. Privacy of Membership

AM has taken reasonable steps to protect the member's privacy. Although we will strive to safeguard the confidentiality of your personally identifiable information, any information transacted over the Internet cannot be made absolutely secure. You also agree to keep your username and password confidential, to avoid any misuse of your profile.

9. Disputes between Members

AM is not a broker or the agent of any AM member. AM Members are solely responsible for the communications with prospects. AM expressly disclaims any responsibility or liability for any transaction or interaction between any AM members. AM has no obligation to monitor any disputes arising between members.

10. Content Right

You acknowledge that you are responsible for the content and information including profile details, photograph and other content keyed in the relevant field of the Website. You represent and warrant that you own all rights to your content or have the necessary licenses. By submitting the content to AM, you grant AM a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, reproduce, distribute and display the content for AM's business and services.

11. Third Party Website

AM may allow third parties to put up advertisements on the Website, and AM does not control the contents of such third party advertisements. Third party websites to which links are given are not governed by these Terms. AM reserves the right to add/delete/alter/modify/suspend any or all the AM Services at any time as it may deem fit, without notice.

12. Limitation of Liability

The exchange of profile(s) through AM should not in any way be construed as a matrimonial offer and/or recommendation and/or advice or guarantee. AM shall under no circumstances be liable for any direct, indirect, special, incidental, or consequential damages. AM's liability to you for any cause whatsoever will at all times be limited to the amount paid, if any, by you to AM for any specific AM paid package, and no further.

13. General

The AM website acts as an intermediary as defined under the Information Technology Act, 2000. In the event you file a false complaint against another prospect and consequently we have suspended/deleted that prospect's profile based on your complaint, we reserve our right to initiate appropriate legal action against you.

14. Disclaimer

Your access to and use of the AM Services or any content is at your own risk. THE AM SERVICES ARE PROVIDED TO YOU ON AN "AS IS" AND "AS AVAILABLE" BASIS. AM does not give any implied or explicit guarantee or warranty of marriage or alliance by you choosing to register on our Website.

15. Indemnity

By using our AM services you agree to defend, indemnify, and hold harmless AM, its subsidiaries, affiliates, Directors, officers, agents, partners and employees, from any loss, damage, liability, claim, or demand made by any person through improper use of the service provided by AM.

16. Breach

If we receive feedback/complaints against your profile relating to seeking physical/financial favors, providing incorrect information, or committing unlawful activities, we reserve our right to suspend/delete your profile at our sole discretion without any notice. AM reserves the right to terminate your membership, block/delete your profile and forfeit the entire amount paid as membership fee.

17. Termination

AM membership may be terminated by AM / you without assigning any reasons by serving 7 days written notice on the other. Upon termination, your right to use or access the AM Website will cease immediately.

18. Jurisdiction and Applicable Law

The registration of AM membership and all AM services are deemed to have been entered into within the territorial jurisdiction of Karnataka, India. All disputes shall be governed by the Laws of India and submitting to the exclusive jurisdiction of the appropriate court of law in Karnataka, India.

19. Trust Badge

We may provide a Trust Badge (applicable for select locations in India only) which encompasses Identity Badge, Social Badge, Professional Badge and Reference Badge. If you opt to avail our verification and Trust Badge service, you agree to provide copies of documents to prove your details. AM does not verify the origin, genuineness or legality of the documents.

20. Mode of Payment

Payment made by cash / Net Banking / Debit / Credit Card would be in accordance with the prevailing RBI guidelines. AM uses third party payment gateways for collection. In the case of failed online transactions which result in no services, AM offers no guarantees for the timeliness of refunds reaching the customer's card/bank accounts.

21. Renewal

All AM paid package users can renew the paid package to carry forward unused contacts. The payments made by AM member are treated as non-refundable. AM members cannot put the paid AM service on hold even temporarily.

22. Special provision for members paying other than in INR

All AM package users paying other than in INR agree that AM shall carry out auto renewal of their package, unless AM is informed in writing against such auto-renewal through registered email.
